Elder Abuse, Nursing Home Claims

November 13, 2010--The disabled and elderly have significant protections under Federal and state law in California.  Most notably, the California Elder Abuse Act affords the family of a mistreated patient access to enhanced remedies including recovery of attorneys fees, punitive damages, and pre-death pain and suffering, in addition to wrongful death damages where appropriate.

Our recent successes involved a demented patient who escaped from a rest home due to an expired battery on his security bracelet (he walked 3 blocks, fell down a ravine and died within days); a patient sent to the doctor's office unescorted who fell and fractured her leg and then also due to poor care received a fatal infection; a woman at a mental hospital who was not properly strapped into her chair and who was found hours later strangled in her straps; and finally an infant who was delivered to her parent's home by a child care provided in a lifeless state.  The first two cases have been successfully resolved and the last two are currently pending.

We can take cases anywhere within California.  Please give us a call.  Attorney John Rozier  559-713-0159.

Fog returns to Bakersfield

November 13, 2010--According to the CHP incident webpage, thick fog returned to the Bakersfield area this morning around 4 am in the Stockdale region near Bakersfield.

According to State law, in California Truck drivers have a greater duty of care to drive safely in fog and rain than do ordinary drivers.  This concept is useful to instruct a jury on the relative responsibilities for causing an accident between a big rig and a private vehicle.  The big rig should pull over when conditions are extreme.

We are currently suing a Juarez Trucking driver for blocking cross traffic during 150 foot visibility fog west of Bakersfield at Taft Highway and Interstate 5.  An oilfield seimic testing supervisor lost his life in a fiery collision which should have been avoided.  Call us if you have been involved in a fog accident in the Central San Joaquin Valley.  Our offices are located in Visalia.  Attorney John Rozier  559-713-0159.

Now that winter is coming up quickly, fog season is beginning as well. There will inevitably be many fog-related accidents this year. Tragically, most of these accidents are completely avoidable if motorists were to drive with the proper precautions. Drivers are reminded to drive at appropriate speeds depending on the weather, to keep a safe following distance between them and the vehicle ahead of them, and to drive with the windows down during especially bad fog in order to hear any traffic incidents ahead especially in rural areas where the fog can be thicker. By taking these simple precautions, all motorists can travel safely through fog season in the Central Valley.

4 month old stops breathing at day care--Adam Ray

October 25, 2010--Last Monday's day care incident in Visalia involving 4 month old Adam Ray is similar to another incident in Porterville last year which is the subject on ongoing litigation.  Suit is proceeding against a Porterville area day care accused of neglect in the death of a two month old infant girl.  The Coroner's report in that case ruled the cause of death to be inhalation of stomach contents and a full State investigation followed.  At the ensuing licensing hearing attorneys for the day care presented expert testimony showing it was an unavoidable SIDS death.  The State of California countered with no expert witness testimony due to lack of budgetary funds.  However, after retaining local counsel expert witnesses have now been located to more fully explain this death.

In the Porterville case the infant child was delivered home from the day care in a lifeless and cyanotic state and paramedics were immediately called to the scene.  The provider had never noticed any trouble.

Issues include the level of supervision provided, whether any health issues had presented that day, whether proper SIDS precautions had been in place, whether older children may have disturbed the infant, etc.

Please call if you would like our expert witnesses to expand the scope of their inquiry to include this situation.  Attorney John Rozier  559-713-0159, a Visalia based Attorney.

The Greyhound bus accident that happened on July 22 on Highway 99 near McKinley Avenue in Fresno took six lives that day. Tests were done to establish a "brake line" where a person should have applied the brakes after seeing an SUV in the road. This line was then used to measure how long it would take for a bus that was up to speed to come to a complete stop after reaching the brake line. Highway 99 accident in Fresno claims 6 lives

July 22, 2010--This morning's massive accident on Highway 99 in Fresno took the lives of 6 victims including a bus driver.  According to the LA Times, few details have yet emerged.

In a case like this the CHP reports can be delayed for 6 to 12 months.  In the meantime vehicles are repaired or salvaged, skids marks dissipate and witnesses return to their daily lives.  Families of victims can protect their rights by retaining expert engineers to review physical evidence right away, downloading the event data recorders for each air bag, obtaining the face page of the CHP report within a couple of days, determining the reason for an SUV being overturned in the roadway in the first place, etc.  Roadway defects need to be eliminated as a possible contributing factor in causing this accident and finally, will perception/reaction experts support the view that the bus driver did all in his power ot prevent this tragedy?

I-5 accident near Stockdale Highway--May 6

May 28, 2010--As an update to the double fatality accident in Kern County on May 6, 2010, we do not know whether the accident report has been completed.  Please place a comment to let us know.  Naomi Mak Johnson of Cotati, California was driving a Honda Pilot which reportedly lost control and veered into a truck.  We have a Honda Pilot and the later models are built with stability control to prevent rolling.  It would be important to determine whether she was side-swiped first by another vehicle.  Sometimes it is too easy to blame the deceased driver as the other drivers cannot be contradicted.  A full investigation will reveal each vehicle speed, including a download of the event data recorders, drug and alcohol testing, paint transfer analysis, etc.

The other victim was Ryan Daniel Bates of Vista.  Paul Rober Bond of Apache Junction, AZ, age 56, was in the first truck hit.  Oscar Gonzalez of Oregon was coming the other direction and was struck head-on.  We do not know whether either of them may share responsibility for this crash.

If the family of either victim, Naomi Mak or Ryan Bates, would like us to investigate this further, then we would be happy to get started upon receiving the proper signatures to permit us to gain access to records, etc.  If there is no case we will simply write off our time and expenses.  If there is a case to be made then we will only charge a fee on a contingency at the end of the case.  Please call when you are ready.  We can mail some forms.  John Rozier 559-713-1059 (work) or 559-627-5242 (home).  You will rest better knowing the true facts.
