December 3, 2009--According to the Visalia Times Delta, last Thursday an industrial accident took the life of an Arizona man at the Lemon Cove Vulcan Materials plant located in Tulare County. The wrongful death victim was identified as Christopher McPherson, age 28. He apparently was installing new equipment as an outside contractor.
Under California law, even though this accident occurred at work, if employees of any company other than his direct employer contributed to the accident then a third party suit can be filed in addition to a workers compensation claim.
