Court awards close to half a million in wrongful death suit
Two years ago Karen Jen was tragically killed when she was out for her daily walk when she was hit by Craig Howard as he was driving home from work. The Fresno County Superior Court awarded the plaintiff, Jen's son, $452,680 for this wrongful death case. Howard was on his cell phone when the accident happened. He had placed calls back to work, but the jury decided that the calls were not required as part of his job. If it had been decided that Howard was "on the job" the settlement could have been much larger as corporations, or cities as is the case in this instance, generally have larger insurance policies to pull from.
