December 29, 2009--Last Tuesday a vehicle driven by a 50 year old Kernville man on Sierra Way near South Fork Bridge in Kernville went down a small embankment killing the driver. His two passengers, identifed as Carry Duncan and Lyndal Vonderahe were both moderately injured and taken to Kern Medical Center for treatment. According to the Bakersfield Californian, the driver was distracted by the use of his cellphone.
The law firm of Nelson and Rozier in Visalia recently handled a similar cellphone caused wrongful death case involving a nine year old child. With legal prohibitions on the use of cellphones while driving, negligence per se may be invoked such that liability would be clear.
