Senate pushed to ban texting while driving nation wide

On January 26 the Transportation Department announced a ban on texting for all truckers and bus drivers. The announcement also called for President Obama to ban texting by all motorists. According to the National Highway Traffic Safety Administration, or NHTSA, 6,000 people were killed nation wide last year by distracted drivers. Another half million people were injured. Laws banning texting are already in place in 18 states. However, Senators are asking for a nationwide ban. The dangers of texting and driving have been proven time and time again. Kernville wrongful death accident caused by cellphone

December 29, 2009--Last Tuesday a vehicle driven by a 50 year old Kernville man on Sierra Way near South Fork Bridge in Kernville went down a small embankment killing the driver.  His two passengers, identifed as Carry Duncan and Lyndal Vonderahe were both moderately injured and taken to Kern Medical Center for treatment.  According to the Bakersfield Californian, the driver was distracted by the use of his cellphone.

The law firm of Nelson and Rozier in Visalia recently handled a similar cellphone caused wrongful death case involving a nine year old child.  With legal prohibitions on the use of cellphones while driving, negligence per se may be invoked such that liability would be clear.  If the victims or their families would like this accident to be investigated further, then please call us. http://www.nelsonrozier.com/

Cellphone Causes Accident

A local Visalia family lost their 9 year old son when a northbound vehicle on Akers Road ran the red light at Hurley while the driver was talking on his cellphone.  The boy was ejected and the vehicle rolled over onto him killing him instantly.  The extended family has now become advocates for strong enforcement of the new laws which ban use of a phone while driving.  A large financial settlement resulted including the establishment of a scholarship fund in their son' name with the local school district.  Attorney John Rozier assisted the family with this difficult process.
