Visalia woman files suit over nursing home death
November 7, 2009--A Visalia woman is filing suit over the death of her mother in a nursing home. After being allowed to attend a doctor's appointment without an escort, albeit in a wheelchair and with an oxygen tank, the nursing home resident fell from the chair and fractured her leg in addition to facial injuries. When returned to the nursing home after leg surgery in the hospital, medical care was inadequate leading to sepsis and double pneumonia and eventual death. The California Department of Health Services investigated this death and issued two large fines (each nearing $18,000) against the facility. Paperwork is now being circulated by the Law Firm of Nelson & Rozier preparatory to filing suit which should take place within a week.
Wrongful death claimants in a case such as this follow California laws of inheritance without a will--in other words the rules of intestate succession. The surviving spouse, surviving children, and even grandchildren may have a claim if their parent does not survive. If you have a family member who has been mistreated at a nursing home please call Attorney John Rozier at 559-713-0159. www.nelsonrozier.com

Kern County oil field automobile accident
Last year the law firm of Nelson & Rozier working together with co-counsel settled a multi-million dollar lawsuit filed in Kern County arising from the oil fields north of Bakersfield. An oilfield worker preparing to spend a week shift on an oil rig drove around doing errands and drinking alcohol. Eventually he veered into the opposing lanes on Highway 65 and killed a mother and father and injured their young son who was a passenger. A second son was not in the vehicle. The suit was filed in Bakersfield, Kern County California. Settlement funds were placed in a trust account controlled by the boy's aunt.

Cellphone Causes Accident
A local Visalia family lost their 9 year old son when a northbound vehicle on Akers Road ran the red light at Hurley while the driver was talking on his cellphone. The boy was ejected and the vehicle rolled over onto him killing him instantly. The extended family has now become advocates for strong enforcement of the new laws which ban use of a phone while driving. A large financial settlement resulted including the establishment of a scholarship fund in their son' name with the local school district. Attorney John Rozier assisted the family with this difficult process.
